In the state of Florida, the most important determining factor in whether or not you will be charged with drug trafficking is the total weight of the drugs. Depending on the type and weight of the drug you allegedly had in your possession, you may be charged and receive a mandatory minimum sentence.
A general outline of the type of drugs and their minimum mandatory amounts are as follows:
- Lysergic Acid Diethylamide (LSD) – 1 to 5 grams will result in a 3-year sentence; 5 to 7 grams will result in a 7-year sentence; greater than 7 grams will result in a 15-year sentence.
- Methamphetamine (Crystal Meth) – 14 to 28 grams will result in a 3-year sentence; 28 to 200 grams will result in a 7-year sentence; greater than 200 grams will result in a 15-year sentence.
- Phencyclidine (Angel Dust or PCP) - 28 to 200 grams will result in a 3-year sentence; 200 to 400 grams will result in a 7-year sentence; greater than 400 grams will result in a 15-year sentence.
- Cocaine - 28 to 200 grams will result in a 3-year sentence; 200 to 400 grams will result in a 7-year sentence; 400 grams to 150 kilograms will result in a 15-year sentence; greater than 150 kilograms will result in a life sentence.
- Cannabis (Marijuana) – Between 25 pounds and 2,000 pounds (or greater than 299 plants) will result in a 3-year sentence. Between 2,000 pounds and 10,000 pounds (or greater than 1,999 plants) will result in a 7-year sentence. Greater than 10,000 pounds will result in a 15-year sentence.
